Here are some commonly asked questions
Do I have to pay for a Notary public to swear the documents?
Notaries charge fees for their professional services. Ask in advance about fees payable for the particular notarial service you require. Except in WA, NSW and VIC and WA, fees are charged on an hourly basis.
Notaries keep a Register or Record of their notarial acts, and often have a photocopy (or other record) of the particular document witnessed or certified.
What is a Notary Public?
A Notary must be a lawyer with at least 5 years of legal practice. A Notary can verify documents for international use. While all rights and responsibilities of Justice of the Peace are also conferred on a Notary, the reverse is not true.
While all of the rights and responsibilities of JoP are performed by a Notary, the reverse is not true (a JoP does not have to be a lawyer).
What if the document is to be served on a company, a director or a corporation?
A document may be served on a company by leaving it at, or posting it to, the company’s registered office; or delivering a copy of the document personally to a director of the company who resides in Australia or in an external Territory. Documents can also be handed to the Director or Company Secretary.
What is a substituted service?
As the name suggests, a substituted service is a way of substituting personal service of documents in a way that will bring the document to the debtor’s attention. This method of delivery can be done via mail, providing someone will bring the document to the debtor’s attention or a combination of multiple service methods.
